Master Agreement and Integration of Documents

These Terms constitute the master agreement between the customer and FjordBites.

By completing a purchase, including by actively accepting at checkout, the customer confirms that the following documents have been read, understood, and accepted as an integral part of the agreement:

– Shipping Policy
– Return & Refund Policy
– Privacy Policy

These documents shall be considered an inseparable part of these Terms and have the same legal effect as if fully incorporated herein, in accordance with general principles of contract law and Sections 1 and 2 of the Norwegian Contracts Act.

In the event of any conflict, these Terms shall prevail unless otherwise required by mandatory law.

1. Scope and Legal Nature of the Agreement

These Terms (“Terms”) govern all use of FjordBites’ services and all purchases made through the online store. The Terms constitute a legally binding agreement between the customer (“Customer”) and FjordBites (“Seller”).

The agreement is governed by and shall be interpreted in accordance with:
– Norwegian Contracts Act (LOV-1918-05-31-4)
– Norwegian Consumer Purchases Act (LOV-2002-06-21-34)
– Norwegian Sale of Goods Act (LOV-1988-05-13-27)
– Norwegian E-commerce Act (LOV-2003-05-23-35)
– Directive 2011/83/EU on consumer rights

By using the services, the Customer is deemed to have provided explicit and binding consent to these Terms.

2. Identification of the Parties

Seller: FjordBites
Organization number: 936 454 526

Customer: Any natural or legal person placing an order.

3. Conclusion of Agreement and Binding Effect

The agreement is considered concluded once the Customer has completed the order and received an order confirmation, cf. Sections 1 and 7 of the Norwegian Contracts Act.

FjordBites reserves the right to reject or cancel orders in cases of:
– obvious errors in pricing or product information
– suspected fraud or misuse
– failure of payment or payment authorization

4. Prices, Charges and Payment Obligations

All prices are stated in the relevant currency and exclude any customs duties and import charges unless explicitly stated otherwise.

The Customer is fully responsible for fulfilling payment obligations, cf. Section 2 of the Norwegian Contracts Act.

Payments are processed through third-party payment providers in accordance with applicable financial regulations.

5. Delivery, Transport and Transfer of Risk

Delivery is carried out in accordance with FjordBites’ Shipping Policy.

The risk for the goods transfers to the Customer upon actual delivery, cf.:
– Section 14 of the Norwegian Consumer Purchases Act
– Section 13 of the Norwegian Sale of Goods Act

Delays caused by third parties or circumstances beyond the Seller’s control do not constitute a breach of contract.

6. Customs Duties, VAT and Import Obligations

For international purchases, the Customer is responsible for all public charges, including:
– customs duties
– value-added tax (VAT)
– import charges

This follows from:
– Norwegian Customs Act (LOV-2007-12-21-119)
– Norwegian VAT Act (LOV-2009-06-19-58)
– EU Regulation (EU) No. 952/2013 (Union Customs Code)

Failure to pay may result in the goods being held or returned without liability for the Seller.

7. Right of Withdrawal, Returns and Breach

The Customer has a right of withdrawal in accordance with the Norwegian Right of Withdrawal Act (LOV-2014-06-20-27), subject to the limitations set out in the law.

Failure to fulfill obligations, including failure to collect or clear goods through customs, constitutes a breach, cf. Sections 51–55 of the Norwegian Sale of Goods Act.

The Seller reserves the right to claim compensation for financial loss, cf. Section 67.

8. Complaints and Defects

In the event of defects, the provisions of the following apply:
– Norwegian Consumer Purchases Act Sections 15–30

Complaints must be made within a reasonable time after the defect is discovered, cf. Section 27.

The Seller may choose between repair or replacement, cf. Section 29.

9. Limitation of Liability

To the extent permitted by mandatory law, FjordBites’ liability is limited to the purchase price of the relevant product.

The Seller disclaims liability for:
– indirect losses, cf. Section 67 of the Norwegian Sale of Goods Act
– loss of profit or consequential damages
– delays or losses caused by third parties

10. Use of Services and Misuse

It is prohibited to:
– use the services in violation of applicable law
– attempt unauthorized access to systems
– misuse payment solutions or identity

Violations may result in immediate suspension and legal action.

11. Intellectual Property

All content on the website is protected by copyright and belongs to FjordBites or its licensors, cf. the Norwegian Copyright Act (LOV-2018-06-15-40).

Any unauthorized use is prohibited and may result in legal sanctions.

12. Privacy and Data Processing

Processing of personal data is carried out in accordance with:
– GDPR (EU 2016/679)
– Norwegian Personal Data Act (LOV-2018-06-15-38)

13. Force Majeure

FjordBites is not liable for failure to perform obligations due to circumstances beyond our control, including but not limited to:
– natural disasters
– war, strikes, or governmental actions
– global logistics disruptions

14. Changes and Invalidity

FjordBites reserves the right to amend these Terms without prior notice, cf. Section 36 of the Norwegian Contracts Act.

If any provision is deemed invalid, this shall not affect the validity of the remaining provisions.

15. Governing Law and Jurisdiction

This agreement is governed by Norwegian law.

Any dispute shall, unless otherwise required by mandatory consumer protection law, be resolved by Norwegian courts, cf.:
– Norwegian Dispute Act (LOV-2005-06-17-90)

Consumers also retain rights under applicable EU/EEA legislation.
