LEGAL NOTICE

1. Purpose and legal nature

This legal notice (‘the Notice’) sets out general legal provisions relating to the use of FjordBites’ services, documents and online platform.

This Notice must be read in conjunction with other terms and guidelines, and forms an integral part of the contractual framework between the parties, cf. the Contracts Act (LOV-1918-05-31-4) Sections 1 and 2.

2. Language and Precedence of Interpretation

FjordBites operates in a multilingual environment.

The original version of all legal documents is drafted in Norwegian. Translations into other languages are intended for guidance only and are provided for the user’s convenience.

In the event of any conflict between language versions, the Norwegian version shall prevail, unless otherwise required by mandatory legislation, including consumer protection legislation within the EEA, cf.:

Directive 2011/83/EU

This applies regardless of which language the user employs when accessing the services.

3. Relationship to applicable legislation

All documents and terms and conditions shall be interpreted in accordance with applicable law, including:

The Consumer Sales Act (LOV-2002-06-21-34)

The Right of Withdrawal Act (LOV-2014-06-20-27)

The Personal Data Act (LOV-2018-06-15-38)

GDPR (EU) 2016/679

The E-Commerce Act (LOV-2003-05-23-35)

If any provision in our terms and conditions or guidelines conflicts with mandatory legislation, the relevant statutory provision shall take precedence.

4. Limitation of liability and clarifications

FjordBites endeavours to ensure that all information is correct and up to date, but makes no guarantees that the content is at all times complete, accurate or free from error.

FjordBites disclaims liability for:

– indirect losses, cf. the Sale of Goods Act (LOV-1988-05-13-27) Section 67

– losses resulting from the acts or omissions of third parties

– technical faults, interruptions or unavailability of the services

This applies to the extent permitted by applicable law.

5. Evidence and documentation

When using the services, including purchases, communications and consents, electronic documentation may be used as evidence, see:

Section 9 of the E-Commerce Act

– general rules of evidence under Norwegian law

Users are advised to retain copies of relevant documentation.

6. International use

The services may be available internationally. Users are responsible for ensuring that their use of the services complies with local legislation in their own jurisdiction.

FjordBites accepts no liability for the use of the services in contravention of applicable laws outside Norway.

7. Amendments and updates

FjordBites reserves the right to update this legal notice as a result of:

– changes in legislation

– regulatory requirements

– operational or technical circumstances

The updated version will be published on the website and shall come into force immediately.

8. Governing law and jurisdiction

This legal notice is governed by Norwegian law, cf.:

the Dispute Act (LOV-2005-06-17-90)

Any disputes shall be settled by the Norwegian courts, unless otherwise required by mandatory consumer protection legislation within the EEA.

Final provision

This legal notice constitutes a legal clarification of FjordBites’ terms and guidelines and shall serve as the basis for interpretation when assessing the parties’ rights and obligations.
