Refund policy
RETURNS AND REFUNDS POLICY

1. Scope and legal basis
This returns and refunds policy applies to all purchases made via FjordBites and forms an integral part of the terms and conditions of purchase.
The right to return and refund is governed by applicable legislation, including:
– The Right of Withdrawal Act (LOV-2014-06-20-27)
– The Consumer Purchases Act (LOV-2002-06-21-34)
– Directive 2011/83/EU on consumer rights
In the event of a conflict between this policy and mandatory legislation, the legislation shall take precedence.
2. Right of withdrawal (right to cancel the purchase)
Consumers have the right to withdraw from the contract within 14 days without giving any reason, cf. Section 21 of the Right of Withdrawal Act.
The period runs from the day the customer receives the goods.
To exercise the right of withdrawal, the customer must give clear notice to FjordBites within the time limit, cf. Section 20 of the Right of Withdrawal Act.
3. Exceptions to the right of withdrawal
The right of withdrawal does not apply to goods which:
a) are not suitable for return for reasons of public health or hygiene and where the seal has been broken, cf. Section 22(g) of the Right of Withdrawal Act
b) are perishable or have a short shelf life, cf. Section 22(b)
c) have been opened, used or cannot otherwise be returned in their original condition
This applies in particular to foodstuffs and food products.
4. Returns process
Upon valid exercise of the right of withdrawal:
a) the goods must be returned without undue delay and no later than 14 days after notification, cf. Section 25 of the Right of Withdrawal Act
b) the goods must be returned in substantially the same condition and quantity
Returns must be sent to the specified return address as agreed with FjordBites.
5. Return costs
The customer shall bear the costs of the return, unless otherwise agreed, cf. Section 25 of the Right of Withdrawal Act.
For international returns, the following applies:
– The customer is responsible for all delivery costs
– The customer is responsible for any customs duties, VAT and import charges incurred on return
6. Refund
Upon approval of the return, the purchase price will be refunded without undue delay and no later than 14 days after we have received notification of the right of withdrawal, cf. Section 24 of the Right of Withdrawal Act.
FjordBites may withhold the refund until the goods have been received or the return has been documented.
Refunds will be made via the same payment method used for the purchase, unless otherwise agreed.
7. Diminished value
The customer may be liable for any diminished value if the goods have been handled in a manner that goes beyond what is necessary to ascertain the nature, characteristics and functioning of the goods, cf. Section 25(3) of the Right of Withdrawal Act.
8. Complaints (defects or faults)
If the goods are faulty, the following provisions apply:
– Sections 15–18 of the Consumer Sales Act
The customer must lodge a complaint within a reasonable time after the fault was discovered, cf. Section 27.
Upon acceptance of a complaint, the customer is entitled to:
– rectification or replacement
– a price reduction or cancellation of the contract
– compensation where the conditions are met
9. Rejected or uncollected consignments
If a consignment:
– is not collected
– is rejected
– is returned due to non-payment of customs duties or charges
this is regarded as a breach of contract on the part of the customer, cf. Sections 51–55 of the Sale of Goods Act.
FjordBites reserves the right to:
a) deduct all costs associated with returns, carriage and handling
b) reduce or refuse a refund
10. Limitation of liability
FjordBites is not liable for:
– delays in return transport
– loss or damage during return shipping
– costs incurred by third parties (carriers, customs authorities)
11. Supplementary return terms (Shopify customisation)
No fees are charged for processing returns (no ‘restocking fee’).
Items marked as final sale, promotional items or special orders cannot be returned, unless otherwise required by mandatory legislation.
12. Amendments
FjordBites reserves the right to amend this policy in accordance with:
– Section 36 of the Contracts Act
– applicable consumer legislation
An updated version will be published on the website.
13. Governing Law and Dispute Resolution
This policy is governed by Norwegian law.
Disputes shall be resolved amicably. If this is not successful, the matter shall be decided by the Norwegian courts, cf.:
– the Dispute Act (LOV-2005-06-17-90)
Consumers may also refer the matter to the relevant complaints body in accordance with applicable EU/EEA regulations.

14. Standard withdrawal form (download)
